Introduction

This privacy policy is to provide information to you, on how your child’s personal information (which includes their health information) is collected and used within, and the circumstances in which we may share it with third parties. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and to the extent applicable, the EU General Data Protection Regulation (GDPR).

Why and when your consent is necessary

When you register your child as a client our clinic, you provide consent for audiologists to access and use your personal information so they can provide you with the best possible healthcare. Only staff who need to see your personal information will have access to it. If we need to use your information for anything else, we will seek additional consent from you to do this.

 

Why do we collect, use, hold and share your personal information?

We need to collect your personal information to provide healthcare services to you. Our main purpose for collecting, using, holding and sharing your child’s personal information is to manage their health. We also use it for directly related business activities, such as financial claims and payments, clinic audits and accreditation, and business processes (eg staff training). We will use your personal information to communicate with you by a variety of measures including, but not limited to, telephone, email, SMS.

What personal information do we collect?

The information we will collect about you includes :

  • Names, date of birth, addresses, contact details

  • Medical information including medical history, medications, allergies, adverse events, immunisations, social history, family history and risk factors

  • Medicare number (where available) for identification and claiming purposes

  • Healthcare identifiers

  • Health fund details.

  • We do not hold any financial information that belongs to you; however, you should be aware that you may be providing financial information to a third party billing service to whom you may be directed at the time of agreeing to a service or purchasing a product on our website. Please ensure that you have thoroughly read their terms and conditions prior to the use of their services, as information provided to a third party is subject to their terms and conditions and not these.

 

How do we collect your personal information?

Our clinic may collect your personal information in several different ways.

  1. Via online registration when you book your child..

  2. During the course of providing hearing services, we may collect further personal information.

  3. We may also collect your personal information when you visit our website, send us an email or SMS, telephone us or make an online appointment.

  4. In some circumstances personal information may also be collected from other sources. Often this is because it is not practical or reasonable to collect it from you directly. This may include information from:

  • Other parent, guardian or responsible person (teacher)

  • Other involved healthcare providers, such as specialists, allied health professionals, hospitals, community health services and pathology and diagnostic imaging services

  • Your health fund, Medicare, or the Department of Veterans’ Affairs (as necessary).

 

When, why and with whom do we share your personal information?

We sometimes share your personal information:

  • With third parties who work with our clinic for business purposes, such as accreditation agencies or information technology providers – these third parties are required to comply with APPs and this policy

  • With other healthcare providers

  • When it is required or authorised by law to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, legal proceedings or in response to a law enforcement agency request.

  • When it is necessary to lessen or prevent a serious threat to a patient’s life, health or safety or public health or safety, or it is impractical to obtain the patient’s consent

  • To establish, exercise or defend an equitable claim

  • For the purpose of confidential dispute resolution process

  • When there is a statutory requirement to share certain personal information (eg some diseases require mandatory notification)

  • If there is a change of control in our business or a sale or transfer of business assets, We reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases.

 

Only people who need to access your child’s information will be able to do so. Other than in the course of providing health services or as otherwise described in this policy, our clinic will not share personal information with any third party without your consent.

 

We will not share your personal information with anyone outside Australia (unless under exceptional circumstances that are permitted by law) without your consent.

 

Our clinic will not use your personal information for marketing any of our goods or services directly to you without your express consent. If you do consent, you may opt out of direct marketing at any time by notifying our clinic in writing.

 

Our clinic may use your personal information to improve the quality of the services we offer to our patients through research and analysis of our patient data.

 

We may provide de-identified data to other organisations to improve population health outcomes. The information is secure, patients cannot be identified and the information is stored within Australia. How do we store and protect your personal information?

Your personal information may be stored in electronic records. Our clinic stores all personal information securely using protected information systems.

  • We are committed to ensuring that the information you provide to us is secure. To prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

  • Where we employ data processors to process personal information on our behalf, we only do so on the basis that such data processors comply with the requirements under the relevant law and that have adequate technical measures in place to protect personal information against unauthorised use, loss, and theft.

  • The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us.  Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this privacy policy.

 

How can you access and correct your personal information at our clinic?

You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth), and to the extent applicable to the EU GDPR. You have the right to request access to, and correction of, your child’s personal information and request access to their medical records. If you would like a copy of the information which we hold about your child or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant, or misleading, please email us at kidshearingclinic@gmail.com.

Our clinic will take reasonable steps to correct your personal information where the information is not accurate or up to date. From time to time, we will ask you to verify that your personal information held by our clinic is correct and current.

  • When you visit our website www.kidshearing.com.au we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.

  • Our site may from time to time have links to other websites not owned or controlled by us. The purpose of these links are for you to book an appointment with us and for your convenience only. Links to third party websites do not constitute sponsorship or endorsement or approval of these websites. Please be aware that we are not responsible for the privacy clinics of other such websites. We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personal identifiable information.

We may modify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board.
